BovineMedia Marketplace Terms & Conditions

1. Marketplace Role

BovineMedia provides an online marketplace where buyers and sellers can buy and sell cattle genetics, including semen, embryos, livestock, and related products.

BovineMedia is not the owner, breeder, storage provider, transporter, or shipper of any products listed unless expressly stated otherwise.

BovineMedia's responsibilities are limited to:

  • Displaying listings.

  • Processing payments.

  • Managing inventory allocated for sale through the BovineMedia marketplace.

  • Authorizing the release of purchased inventory to the designated storage facility.

  • Providing transaction notifications to buyers and sellers.

BovineMedia is not responsible for post-sale disputes, product warranties, returns, exchanges, refunds, breeding performance, shipping arrangements, or transportation. Any issues regarding the quality, condition, performance, suitability, warranties, guarantees, returns, exchanges, or refunds must be resolved directly between the Buyer and the Seller.

BovineMedia acts solely as an independent marketplace platform and transaction facilitator. Nothing contained in these Terms creates an agency, partnership, joint venture, employment relationship, or fiduciary relationship between BovineMedia and any Buyer or Seller.

2. Seller Responsibilities

Each Seller represents and warrants that:

  • They own or have legal authority to sell the listed products.

  • All listing information is accurate to the best of their knowledge.

  • All inventory allocated to BovineMedia is available for sale.

  • They will promptly notify BovineMedia if their allocated inventory changes.

  • They have the authority to authorize release from the designated storage facility.

The Seller remains solely responsible for:

  • Pedigree information.

  • Registration information.

  • EPD information.

  • Genetic claims.

  • Health information.

  • Breeding guarantees.

  • Fertility guarantees.

  • Product warranties.

  • Customer service after the sale.

The Seller agrees to handle all customer service regarding breeding performance, product quality, guarantees, returns, replacements, exchanges, refunds, and any other post-sale issues directly with the Buyer.

3. Buyer Responsibilities

By purchasing through BovineMedia, the Buyer agrees that:

  • All purchases are legally binding.

  • They have reviewed the listing before purchasing.

  • They are responsible for all shipping costs unless otherwise stated.

  • They will coordinate shipment directly with the Seller and/or the designated storage facility.

  • They are responsible for complying with all applicable local, state, federal, international, and breed association requirements.

The Buyer acknowledges that any warranty, guarantee, replacement policy, breeding guarantee, or return policy is established solely by the Seller and not by BovineMedia.

4. Payment

Payment is due in full at checkout.

Upon successful payment:

  • Inventory will automatically be reduced.

  • The transaction will be considered complete.

  • BovineMedia will issue a release authorization to the designated storage facility.

  • Buyer and Seller will receive confirmation of the completed transaction.

5. Release Authorization

Once payment has been received, BovineMedia will authorize the release of the purchased inventory to the designated storage facility.

Release authorization is not shipment.

The Buyer is responsible for coordinating shipment directly with the Seller and/or the storage facility.

6. Shipping

The Buyer is solely responsible for:

  • Coordinating shipment.

  • Selecting a carrier.

  • Shipping costs.

  • Insurance.

  • Transfer fees.

  • Tank rental fees.

  • Storage fees after purchase.

  • Any additional transportation costs.

BovineMedia does not:

  • Store semen or embryos.

  • Package shipments.

  • Arrange transportation.

  • Select shipping carriers.

  • Take possession of purchased products.

  • Transport purchased products.

7. Risk of Loss

Once BovineMedia has issued release authorization to the designated storage facility, responsibility for shipment transfers to the Buyer and Seller.

BovineMedia is not liable for:

  • Shipping delays.

  • Shipping damage.

  • Lost shipments.

  • Carrier performance.

  • Storage facility delays.

  • Transfer delays.

  • Weather-related delays.

  • Additional shipping costs.

8. Listing Accuracy

Listing information is provided by the Seller.

While BovineMedia makes reasonable efforts to maintain accurate listings, BovineMedia does not guarantee:

  • Pedigree accuracy.

  • Registration accuracy.

  • EPD accuracy.

  • Genetic performance.

  • Fertility.

  • Conception rates.

  • Pregnancy rates.

  • Health status.

  • Product suitability.

Buyers are responsible for conducting their own due diligence before making a purchase.

9. Returns & Refunds

Due to the nature of cattle genetics and biological products, all sales are considered final unless otherwise agreed to by the Buyer and Seller.

Any return, exchange, refund, replacement, warranty claim, breeding guarantee claim, or other post-sale resolution is solely between the Buyer and the Seller.

BovineMedia is not a party to return or refund negotiations and does not determine eligibility for returns or refunds.

BovineMedia may issue a refund only if:

  • A payment processing error occurred.

  • A duplicate payment was made.

  • Inventory was unavailable due to an inventory allocation error.

  • The transaction could not be completed before release authorization.

Once BovineMedia has authorized release of the purchased inventory, any request for a refund, replacement, exchange, warranty claim, breeding guarantee, or compensation must be handled directly between the Buyer and the Seller.

10. Limitation of Liability

BovineMedia acts solely as an online marketplace and transaction facilitator.

BovineMedia shall not be liable for:

  • Disputes between Buyers and Sellers.

  • Breeding performance.

  • Fertility.

  • Conception rates.

  • Pregnancy rates.

  • Genetic defects.

  • Product quality.

  • Shipping delays.

  • Shipping damage.

  • Lost shipments.

  • Storage facility errors.

  • Carrier errors.

  • Indirect, incidental, consequential, or special damages.

11. Dispute Resolution

Any dispute regarding:

  • Product quality.

  • Pedigree.

  • Registration.

  • Genetic performance.

  • Breeding guarantees.

  • Fertility.

  • Shipping.

  • Storage.

  • Health documentation.

  • Returns.

  • Exchanges.

  • Refunds.

shall be resolved directly between the Buyer and the Seller.

BovineMedia may assist in facilitating communication but is under no obligation to investigate, mediate, or resolve disputes.

12. Inventory Allocation

All inventory displayed on BovineMedia represents inventory allocated by the Seller specifically for sale through the BovineMedia marketplace.

If inventory allocation changes, the Seller agrees to promptly notify BovineMedia.

In the event of an inventory allocation error, BovineMedia reserves the right to cancel the transaction and issue a full refund prior to release authorization.

13. Buyer Acknowledgment

By placing an order through BovineMedia, the Buyer acknowledges and agrees that:

  • BovineMedia is acting solely as an online marketplace.

  • Payment authorizes BovineMedia to issue release authorization to the designated storage facility.

  • The Buyer is responsible for coordinating shipment with the Seller and/or storage facility.

  • The Buyer is responsible for all shipping, transfer, storage, insurance, and transportation costs unless otherwise stated.

  • BovineMedia does not transport, store, or ship purchased products.

  • Any return, exchange, refund, warranty claim, or breeding guarantee claim will be handled directly between the Buyer and the Seller.

14. Acceptance of Terms

By using the BovineMedia marketplace or placing an order, Buyers and Sellers acknowledge that they have read, understood, and agree to be bound by these Terms & Conditions.
